Terms of Use

Please read these Terms of Use ("Terms") carefully before using the HomeGrove mobile application ("App") or the HomeGrove website at homegrove.app ("Website"), operated by QVO Group ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

HomeGrove is a home maintenance reminder and tracking application for iOS. The App helps users manage maintenance schedules, track service history, store contractor contact information, and log equipment details. All user data is stored exclusively on your personal iCloud account using Apple's CloudKit framework.

2. MAINTENANCE INFORMATION DISCLAIMER — PLEASE READ CAREFULLY

HomeGrove provides maintenance reminders, suggested maintenance schedules, and general home care information for INFORMATIONAL PURPOSES ONLY. HomeGrove IS NOT a substitute for professional home inspection, maintenance, or repair services.

You expressly acknowledge and agree that:

2.1 No Warranty on Accuracy

Maintenance schedules, intervals, and recommendations provided by HomeGrove are general suggestions based on common industry guidelines. They may not be appropriate for your specific home, equipment, climate conditions, local regulations, or circumstances. HomeGrove makes no representation or warranty that any maintenance schedule or recommendation is accurate, complete, current, or appropriate for your situation.

2.2 No Liability for Home or Equipment Damage

HomeGrove, QVO Group, and their officers, directors, employees, and affiliates shall not be liable for any damage to your home, property, equipment, appliances, systems, or any other property that may result from following, not following, or partially following any maintenance suggestion, reminder, or recommendation provided by the App. This includes but is not limited to:

  • Water damage from delayed or missed maintenance
  • HVAC system failures or reduced equipment lifespan
  • Appliance breakdowns or malfunctions
  • Structural damage to your home or property
  • Mold, mildew, pest, or environmental damage
  • Fire, electrical, or safety hazards
  • Voided manufacturer warranties due to improper or untimely maintenance
  • Plumbing failures, leaks, or water system damage
  • Roof damage or deterioration
  • Any consequential, incidental, special, or indirect damages of any kind

2.3 No Liability for Personal Injury

HomeGrove provides general maintenance reminders only. Performing home maintenance can involve physical risks including but not limited to ladder falls, electrical hazards, chemical exposure, tool injuries, heavy lifting injuries, and exposure to hazardous materials (asbestos, lead paint, mold). HomeGrove is not responsible for any personal injury, disability, or death that may occur during the performance of any maintenance task, whether or not suggested by the App.

2.4 User Assumes All Risk

You assume full and sole responsibility for all maintenance decisions you make regarding your home, including the decision to perform maintenance yourself ("DIY") versus hiring a qualified professional. HomeGrove's complexity tags ("quick," "weekend," "professional") are general suggestions only and do not constitute professional advice about what requires professional service in your specific situation.

2.5 Consult Qualified Professionals

You should always consult qualified, licensed professionals for:

  • Any maintenance involving electrical systems or wiring
  • Any maintenance involving gas lines, gas appliances, or fuel systems
  • Any maintenance involving structural elements of your home
  • Any maintenance involving your roof or roofing systems
  • Any maintenance involving plumbing or water systems
  • Any maintenance involving HVAC systems beyond basic filter changes
  • Any maintenance you are not confident performing yourself
  • Any situation where safety is a concern

2.6 Equipment Manufacturer Guidelines Prevail

Always follow the manufacturer's maintenance schedule and guidelines for your specific equipment and appliances. HomeGrove's general recommendations may differ from manufacturer specifications. When in conflict, always follow the manufacturer's guidelines.

2.7 Local Laws and Regulations

Some maintenance tasks may be regulated by local building codes, homeowner association rules, or may require licensed professionals in your jurisdiction. HomeGrove does not account for local, state, or federal regulations. You are solely responsible for complying with all applicable laws and regulations in your area.

3. Purchase and Trial

HomeGrove offers a 7-day free trial with full access to all features, beginning from the date you first install the App. After the trial period, continued access to certain features requires a one-time in-app purchase of $4.99 (USD) through Apple's App Store.

3.1 Free Features (Always Available)

  • Viewing all existing data (tasks, contacts, equipment, service history)
  • Receiving scheduled notifications and reminders
  • Marking tasks as complete
  • Logging service history on existing tasks
  • Viewing service contacts and contractor details

3.2 Paid Features (Require Purchase After Trial)

  • Adding new maintenance tasks
  • Adding new service contacts

3.3 Payment Terms

  • The purchase is non-consumable and provides lifetime access
  • Payment is processed entirely by Apple — HomeGrove does not handle payments
  • You may restore your purchase on any device signed into the same Apple ID via Settings > Restore Purchase
  • Refund requests must be directed to Apple per their refund policy

4. Data Storage and Loss

Your data is stored in your personal iCloud account. HomeGrove does not maintain backups of your data. You are responsible for maintaining adequate iCloud storage and ensuring your iCloud account is in good standing.

HomeGrove shall not be liable for any loss of data resulting from:

  • iCloud service outages, errors, or interruptions
  • Insufficient iCloud storage space
  • Issues with your Apple ID or iCloud account
  • Device loss, damage, theft, or factory reset
  • App deletion or reinstallation
  • iOS updates or compatibility issues
  • Use of the "Delete All Data" feature in Settings
  • Any other cause beyond our reasonable control

5. User Conduct

You agree to use the App only for its intended purpose of personal home maintenance tracking. You agree not to:

  • Attempt to reverse-engineer, decompile, or disassemble the App
  • Use the App for any commercial property management or professional inspection service without our written consent
  • Distribute, sublicense, or make the App available to third parties
  • Use the App in any way that violates applicable laws

6. Intellectual Property

The App, including its design, code, content, maintenance library, and documentation, is the intellectual property of QVO Group and is protected by copyright and other intellectual property laws. The 101-item maintenance library and 5-layer filtering algorithm are proprietary to HomeGrove.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The App will meet your specific requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • Maintenance recommendations will be accurate or appropriate for your home
  • Maintenance intervals will prevent damage or extend equipment life
  • The App will be compatible with future iOS versions
  • iCloud syncing will function without interruption

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QVO GROUP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Damage to your home, property, or equipment
  • Personal injury or death
  • Loss of data
  • Loss of profits or revenue
  • Cost of substitute services
  • Voided warranties
  • Insurance claim denials

WHETHER ARISING FROM CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (i.e., $4.99 USD).

9. Indemnification

You agree to indemnify, defend, and hold harmless QVO Group and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of or inability to use the App
  • Your violation of these Terms
  • Any maintenance you perform or fail to perform on your home, whether or not suggested by the App
  • Any damage to your home, property, or equipment arising from maintenance activities
  • Any personal injury occurring during home maintenance activities
  • Any claim by a third party related to your home's condition or maintenance
  • Your violation of any rights of another party
  • Your violation of any applicable law or regulation

10. Apple App Store Terms

These Terms are between you and QVO Group, not Apple. However, you acknowledge that:

  • Apple has no obligation to furnish maintenance or support services for the App
  • In the event of any failure of the App to conform to applicable warranties, Apple's sole obligation (and our sole liability) shall be the refund of the purchase price, if any
  • Apple is not responsible for addressing claims relating to the App, including product liability, legal compliance, or intellectual property
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of New Jersey.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms.
